The Accident Compensation Corporation has been granted leave to appeal a court ruling requiring it to fund care for a baby born with Down syndrome and other conditions. The mother applied for coverage after being advised that further testing was unnecessary. ACC is appealing on the basis that the decision to continue the pregnancy could be considered a treatment injury.
